Winnebago County State’s Attorney Marilyn Hite Ross announces that a Grand Jury has returned an indictment against a Roscoe man for an attack and sexual assault in March

On March 13th, 2019, Roscoe Police Officers responded to the 5900 Block of McDonald Road to find a female victim, who was visibly injured.

The woman was taken to the hospital to be treated for non-life threatening injuries.

Detectives determined that the victim was abducted from inside her own residence and taken to the 5900 Block of McDonald Road where she was both physically and sexually assaulted.

During a follow up investigation, the defendant, Matthew S. Harkey (D.O.B. 11/11/1975) was quickly identified as the suspect. The Winnebago County State’s Attorney’s Office reviewed the investigation and as a result, Harkey was charged, then recently indicted by a Grand Jury.

He faces a multiple count bill of indictment that includes charges of Attempt First Degree Murder, Aggravated Criminal Sexual Assault, Aggravated Kidnapping, Home Invasion, Residential Burglary, Aggravated Criminal Sexual Abuse, Aggravated Stalking and Unlawful Restraint.

Attempt First Degree Murder is a Class X Felony that is punishable by a sentence of 6-30 years in the Illinois Department of Corrections followed by three years of Mandatory Supervised Release.

Aggravated Criminal Sexual Assault is a Class X Felony that is punishable by a sentence of 6-30 years in the Illinois Department of Corrections followed by three years of Mandatory Supervised Release.

Aggravated Kidnapping is a Class X Felony that is punishable by a sentence of 6-30 years in the Illinois Department of Corrections followed by three years of Mandatory Supervised Release.

Home Invasion is a Class X Felony that is punishable by a sentence of 6-30 years in the Illinois Department of Corrections followed by three years of Mandatory Supervised Release.

Residential Burglary is a Class 1 Felony that is punishable by a sentence of 4-15 years in the Illinois Department of Corrections followed by two years of Mandatory Supervised Release.

Aggravated Criminal Sexual Abuse is a Class 2 Felony that is punishable by a sentence of 3-7 years in the Illinois Department of Corrections followed by two years of Mandatory Supervised Release.

Aggravated Stalking is a Class 3 Felony that is punishable by an extended sentence of 2-10 years in the Illinois Department of Corrections followed by four years of Mandatory Supervised Release.

Unlawful Restraint is a Class 4 Felony that is punishable by an extended sentence of 1-6 years in the Illinois Department of Corrections followed by a year of Mandatory Supervised Release.

Harkey is currently in the custody of the Winnebago County Jail. He is scheduled to be arraigned on the indictment at 9:00am on April 30th, 2019, in front of the Honorable Judge Joseph McGraw in Courtroom A at the Winnebago County Criminal Justice Center.

The charges are merely allegations and the defendant is presumed innocent until or unless proven guilty in a court of law
