On 12-02-18 at 1:41 a.m. a Janesville Police Officer heard a gunshot in the area of N. Atwood Ave. and E. Wall St. Additional officers responded to the area and located 2 subjects by the names of Matthew Burr and Eugene Harp fighting in the area of that intersection. Both subjects were detained while the matter was investigated. Both subjects were uncooperative and denied hearing any gunshots.

Further investigation revealed that Eugene was taking his dog outside when Matthew, who was walking by, got upset that Eugene’s dog was barking.

Eugene and Matthew ended up in a physical altercation. At some point during the altercation Eugene displayed a firearm and shot off one round. No one was struck by the gunshot. Eugene suffered injuries that did not need immediate medical attention. The 9mm handgun that was fired was later located in a nearby residence and seized as evidence.

Matthew was charged with Substantial Battery. A criminal history check revealed Eugene was a convicted felon. Eugene was charged with Intoxicated use of a Firearm and Felon in Possession of a Firearm. Both subjects were held at the Rock County Jail pending their initial court appearance.
