On April 4, 2000, the Janesville Police Department responded to 922 Sutherland for a forcible rape and burglary that occurred during the early morning hours. On that date an unknown male suspect entered the home of a then 79 year old female victim and sexually assaulted her. After assaulting the victim, the suspect fled the scene.
Various items of evidence were collected from the crime scene including DNA evidence which was submitted to the Wisconsin State Crime Lab for analysis. The suspect was never able to be identified and the case eventually went cold after all investigative leads were followed up on.
On January 12, 2017 the Janesville Police Department received notification from the Wisconsin Crime Lab that they conducted a routine search of the Combined DNA Index System (CODIS) which revealed a match between the DNA previously submitted by the Janesville Police Department on the 2000 forcible rape and burglary case to a male suspect by the name of Kelly L. Baxter.
In August 2014 Baxter was arrested by the Rock County Sheriff’s Office for an unrelated sexual assault to a child incident, and later convicted in August 2016 of 4th degree sexual assault. As a result of the conviction, per state law, Baxter’s DNA was collected and submitted to the Wisconsin State Crime lab to be entered into CODIS in November 2016. The submission of Baxter’s DNA resulted in a match to the 2000 case.
On 02-22-17, Janesville Police Detectives arrested Baxter at the Janesville Police Department for the 2000 sexual assault and burglary. Baxter is currently being held at the Rock County Jail for court.
